Reminder: If you need to hire foreign and overseas Chinese students, they shall present valid work permits, and please observe the permitted stay duration in order to ensure legal employment and protect employment rights.

With the winter vacation and Chinese New Year drawing near, many students will take the opportunity to engage in part-time work. Labor Affairs Bureau hereby reminds that according to the Employment Service Act, foreigners may not work in the Republic of China without prior consent; therefore if foreign and overseas Chinese students intend to obtain part-time work, they must apply for a work permit as required by the law. Before hiring foreign and overseas Chinese students, employers should ask them to present their work permit and pay attention to the permitted stay duration in order to ensure legal employment and protect employment rights.
According to Article 50 of the Employment Service Act, Foreign students enrolled in a public or registered private college/university, and overseas Chinese students and other foreign students of Chinese origin enrolled in a public or registered private high or higher school may be employed to engage in work in the Republic of China; with the exception of the winter and summer vacations, their sum of working hours shall not exceed 20 hours per week. In addition, they should apply for work permit from the Ministry of Labor in accordance with the Employment Service Act and relevant decrees. Labor Affairs Bureau hereby reminds that foreign and overseas Chinese students should observe if their work permits have expired before assuming part-time work, those who have yet to apply for work permit or those whose work permits have expired may not engage in work, as illegal workers will not only be fined and deported within a specified time, their rights to stay and work in Taiwan will also be jeopardized. If foreign and overseas Chinese students need to apply for work permit, please do so online via EZ Work Permit (https://ezwp.wda.gov.tw), which offers 24-hour, bilingual (Chinese and English) online application, payment, notification, and checking services for the convenience of the students.
Recently, many employers have been found to be negligent in hiring foreign and overseas Chinese students without checking their work permit or legal identity. According to the Employment Service Act, no one may illegally let foreign worker stay and engage in work, employ a foreign worker without permit or after the expiration of permit, or a foreign worker that has been permitted to be employed at the same time by a third party. Violators shall be fined an amount of at least NT$150,000 and at most NT$750,000, therefore employers should be careful and comply with the law. Labor Affairs Bureau hereby reminds that employers should ask foreign and overseas Chinese students to present their work permit and observe the expiration date before hiring them; if you have any doubts about the work permit, please contact the Ministry of Labor at 02-89956000 in order to prevent potential fines due to the mis-hiring of unauthorized foreign and overseas Chinese students.
